Frequently Asked Questions about the User Agreement Revision
We are committed to improving your experience at eBay.co.uk. In order to ensure that your terms and conditions ("the User Agreement") with us remains up to date, and to accommodate future site developments, we have revised the User Agreement and the Privacy Policy. Some of these revisions are based on suggestions from the community and others are necessary due to the developments in our website and the changing legal environment in which eBay.co.uk and its community operates. | Q. |
How do I benefit from this revision? |
| A. |
This revision generally updates and clarifies the wording of the previous User Agreement to make it easier to understand, with a specific focus on highlighting the importance of password security and strengthening our ability to deal with fraudulent users.
|
 |
| Q. |
Will the User Agreement ever change again? |
| A. |
It may change periodically due to improvements or developments which we make to the eBay site. When revisions are needed, changes will be posted on the site at least 30 days before
taking effect. You also have the option to receive email notices of any revisions as they occur. To select this
option go to the preferences page
from my eBay and then review your notification preferences. No revisions will occur without notice to the
Announcement Board and/or email to those who requested
such notice as necessary.

 |
| Q. |
What do I do now? |
| A. |
You do not need to do anything if you are already an eBay user and wish to accept the revised User Agreement once it is effective on 8 January 2004. If you do not wish to accept the revised User Agreement you may cancel your eBay
registration by emailing
ukdecline@ebay.com If you have any current listings when you do this, these
will continue normally. However, you will not be able to access any service or feature that requires you to enter a
password once your cancellation request is processed.

| Q. |
What are the revisions? |
| A. |
The major revisions are described below. Please be aware that while we have summarised the major changes below,
there are additional changes that are not summarised and therefore, you are encouraged to read the
User Agreement to see the full text of the revisions
to the User Agreement.
Use of Passwords. We have clarified the wording in paragraph 2 to make it clear that all users should keep their passwords safe from disclosure and should not disclose their passwords to any other person.
Feedback. We may limit the number of bids and listings users may place on the Site and other activities on the Site based upon the user's feedback level. For example, to sell with Buy It Now, you must have either a minimum feedback rating of 10 or be signed up for Direct Debit.
Listing Description. We have added provisions to deal with an increasing number of listings that contain irrelevant content or that are listed in the wrong category, as this detracts from the vibrancy of our marketplace. For example, you must describe your item and all terms of sale on the listing page of the Site and you are responsible for ensuring that you have the right to use all content in your listings.
Fraud. Due to the importance of this issue to the eBay community, we have strengthened our ability to deal with users that we suspect are acting fraudulently.
Fees. We have clarified that from time to time we may amend the fees we charge you, for example during promotional events, and we will tell you about this beforehand.
Access and Interference. We have strengthened the provisions relating to unauthorised access or use of our website.
Your Use of Other Users' Information. Due to the importance of ensuring that all users in the eBay community respect each other's privacy and personal information, we have included the obligations on all users from our Privacy Policy into the User Agreement, which means that they are now legally binding obligations.
Our liability. We have amended the limitation of our liability to our users to be the greater of (a) the total fees you have paid to us in relation to the listing or other service offered giving rise to liability, and (b) £100. We believe that this is more reasonable.
Arbitration. We deleted the provisions relating to arbitration as we will make every effort, where possible, to resolve issues without the need to use formal procedures.
