Frequently Asked Questions about the User Agreement Revision

With effect from 1st March, 2007, we are updating our User Agreement.

The main change is that, for eBay users who are resident in the European Union, the contractual relationship between those users and eBay International AG will be transferred to eBay Europe S.à r.l., a new eBay entity located in Luxembourg.

We are committed to improving your experience of using eBay. We have therefore taken this opportunity to make further changes to the User Agreement to make sure it stays up to date. Some of the changes are based on suggestions from the community and others are necessary due to site developments.

Q. How does this change affect me?

A. This revision generally updates and clarifies the wording of the previous User Agreement to make it easier to understand, with a specific focus on strengthening our ability to deal with fraudulent users.

Q. Will the User Agreement ever change again?

A. It may change periodically. When revisions are needed, changes will be posted on the eBay website at least 30 days before taking effect. You will also receive email notices of any revisions as they occur.

Q. What do I do now?

A. You do not need to do anything if you are already an eBay user and wish to accept the revised User Agreement once it becomes valid on 1st March, 2007. If you do not want to continue using eBay under the new User Agreement, please inform us of this before March 1st. In this case we will cancel your eBay registration. See here for more information on closing your account. You’ll need to complete any open listings or bids and ensure your seller account balance is zero before we can close your account. You will not be able to access any service or feature that requires you to enter a password once your cancellation request is processed.

Q. What are the revisions?

A. The major revisions are described below. Please be aware that while we have summarised the major changes below, there are additional changes that are not summarised and therefore, you are encouraged to read the new User Agreement to see the full text of the revisions to the User Agreement.

Under the previous User Agreement eBay users resident in the European Union had a contractual relationship with eBay International AG. Under the revised User Agreement, for those users, that contractual relationship is with eBay Europe S.à r.l., a new eBay entity located in Luxembourg. This change reflects a change in eBay's EU structure. To find out more about this change and how it may affect you, please see our information page.

The User Agreement has been simplified and consolidated, unnecessary wording has been removed and the sections are no longer numbered. Some of the section headings have been changed so that they more clearly describe the content of the sections to which they relate. In addition, the sections have been re-ordered so that the User Agreement is easier for you to read.

The User Agreement no longer contains information about eBay's different listing formats, so it will not need to be updated if any new formats are introduced in future. Information about listing formats can be found in our Help Centre.

The sections previously headed Your Use of Other Users’ Information (7.5) and Use of Email Tools (7.6) have been revised. There is now a section focusing only on the prohibition of spam email communications, headed No Spam. The other restrictions on using other users’ information are contained in the section headed Using information about other eBay users.

There is a new section headed Privacy, which contains a brief description of how we use and protect your personal information and refers you to our Privacy Policy for further information. This section includes wording from the section previously headed Transfer of Data (9).

There is a new section headed Additional terms which contains links to various eBay policies which form part of the User Agreement
