eBay UK: Shop Without Sharing

TERMS AND CONDITIONS

This Shop without Sharing promotion ("Promotion") is open to all UK residents aged 18 years or over registered on any eBay site, except any employees (and their families) of eBay International A.G. ("eBay") or PayPal Europe Limited ("PayPal"), their affiliates, subsidiary companies, any representatives or agents of those companies and anyone else who may be professionally involved with the Promotion. PayPal reserve the right to verify the eligibility of entrants. The Promotion begins at 00:00:01 BST on Monday 20th March and finishes at 23:59:59 BST on Monday 17th April 2006 ("Promotional Period").
In order to get into the Promotion pages, entrants will first need to click on the 'Enter Now' button at http://www.ebay.co.uk/shopwithoutsharing/index.html
To enter the Weekly Prize Draw to win one of the Weekly Prize Draw prizes: Entrants must do the following on www.ebay.co.uk ("eBay Site") during the Promotional Period:
Entrants will be eligible to enter into the Weekly Prize Draw once for each item they buy. There is a limit of five "buy" entries that entrants can make per day during the Promotional Period. Each combination of eBay User ID and item number will only be a valid entry once during the Promotional Period. An item number for an item that is validly bought during the Promotional Period may be used once to enter the Weekly Prize Draw on any day during the Promotional Period.
Once an entrant has successfully entered the promotion, that entrant will be able to play the 'Play it Safe' game, and by playing may earn themselves an additional entry into the Weekly Prize Draw.
No purchase necessary: In order to enter the Weekly Prize Draw via the no purchase necessary route, the entrant must (a) go to the "Shop without Sharing" landing page (b) click on the "Enter Now" button, (c) enter their eBay user ID and write the text "no purchase" in the "item number" box on the Promotion Page and (d) click on "Submit". Entry via the No Purchase Necessary route is limited to five entries per person per day during the Promotional Period.
The prizes: The Weekly Prize Draw prizes consist of 5 Creative Zen Vision: M MP3 players, 3 Sony DVD Camcorders and a 32in Sony LCD TV. The Grand Prize Draw prize will be a Mini Cooper S Convertible. The winner of the Mini Cooper S Convertible will be responsible for collecting the vehicle from a west London location. PayPal and eBay will not be responsible for delivery of the vehicle. The vehicle will come with one year's road tax and will have a full tank of petrol. The winner is responsible for making their own arrangements for insurance and maintenance of the vehicle and must provide full insurance details including an original copy of their valid insurance certificate approximately two weeks prior to collection. The winners of the Weekly Prize Draw prizes will have their prizes delivered to the address associated with their eBay account.
Entrants may only win one Weekly Prize Draw prize per entrant and not per eBay User ID and in addition each entrant will also be eligible to win the Grand Prize Draw prize. The prizes are not transferable and there will be no cash or alternatives prizes possible.
The Weekly Prize Draws will take place at midnight on 27 March, 3 April, 10 April and 17 April. The winner of each Weekly Prize Draw prize will be the entrant whose name is selected at random from all the valid entries received by PayPal by the date of the Weekly Prize Draw. The Weekly Prize Draws will be conducted by an independent agency.
The Grand Prize Draw to win a Mini Cooper S Convertible will take place on 18 April at midnight and the winner of the Grand Prize will be the entrant whose name is selected at random from one valid entry received from each entrant during the Promotional Period.
Entrants who win a Weekly Prize Draw prize will be excluded from each subsequent Weekly Prize Draw during the Promotional Period, however, all valid entries which have not been seleted in the Weekly Prize Draw will be included in each remaining Weekly Prize Draw.
Winners of the Weekly Prize Draw prizes will be notified by telephone or email to the telephone number or email address provided to PayPal within 14 working days of each Weekly Prize Draw date. PayPal will supply the Weekly Prize Draw winners with their prizes within 28 working days from the end of the Promotional Period. The winner of the Grand Prize Draw Mini Cooper S Convertible prize will be notified by telephone or email to the telephone number or email address provided to PayPal within 14 working days of the Grand Prize Draw. The winner of the Mini Cooper S Convertible will agree a collection time with PayPal and the winner shall be responsible for collecting the vehicle from a west London location.
Entrants shall be responsible for ensuring that the contact details associated with the eBay User ID and PayPal account they are entering with are up to date and accurate so they can be contacted if they win. If PayPal or their authorised agents are not able to contact the winners by midnight 14 days after the first attempted notification, an alternative winner will be selected at random and the original winners' entitlement will lapse.
PayPal may ask for proof from buyers to verify that they have paid for their item within 24 hours of the listing end (sufficient proof may include a PayPal payment receipt, a credit card receipt or other documentary evidence acceptable to PayPal). PayPal may also ask winners to provide proof of their age and/or country of residence.

If PayPal has suspicions or knowledge that any entrant has been involved in any fraudulent, illegal or inappropriate activity, PayPal reserves the right to disqualify that entrant and any related entrants.
PayPal may also disqualify any entrant that does not act in accordance with these terms and conditions or eBay's rules and policies and PayPal's User Agreement.
Entrant's eBay account must be in good standing, including feedback not below zero with no overdue fees during the Promotional Period until the delivery of the prize.
In the event of circumstances arising outside PayPal's control, which in PayPal's opinion make it necessary to suspend, change or cancel the Promotion, PayPal reserves the right to suspend, change or cancel the Promotion at any time. This includes the ability to substitute any prize of equivalent value, change the specification of the prize if circumstances require it or change the entry methods.
PayPal or the prize providers reserve the right to add additional terms and conditions for certain prizes awarded as a part of this Promotion.
English Law governs the Promotion. By entering, entrants agree to be bound by these terms and conditions and the PayPal.co.uk User Agreement including without limitation Clauses 7.1 and 7.2. The definition of "Your Information" in Clause 7.1 includes any information or content the entrant provides to PayPal for the purposes of the Promotion. In particular you must not use any offensive or profane language when describing the item you are listing for sale. PayPal reserves the right to disqualify any entrant who uses offensive or profane language.
PayPal and eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit PayPal's and eBay's liability for death, personal injury or fraud.
By entering, winners irrevocably grant PayPal permission to use his or her name, likeness, biographical and PayPal related information for advertising, promotional or publicity purposes, including on the prize winners page at {insert link}. The winner may also be required to sign a Publicity Release Form.
PayPal does not accept, and is not responsible for, any lost or delayed entries. PayPal remind entrants of the nature and limitations of the Internet and are not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion or receipt of prizes.
Although PayPal will use reasonable efforts to ensure that all information relating to the Promotion ("Promotional Material") is accurate, PayPal are not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect PayPal's operation of the Promotion or the PayPal site, including without limitation the accuracy of any Promotional Material.
PayPal may use third parties to facilitate one or more elements of this Promotion and may provide some of your personally identifiable information to them. These third party service providers are subject to confidentiality agreements with PayPal and other legal restrictions that prohibit the use of the information PayPal provide them for any other purpose except to facilitate the specific outsourced PayPal related operation.
