The Great British Stocking Filler

This Great British Stocking Filler promotion ("Promotion") is open to all UK residents aged 18 years or over registered on any eBay site, except any employees (and their families) of eBay International A.G., its affiliates, subsidiary companies ("eBay"), any representatives or agents of those companies and anyone else who may be professionally involved with the Promotion. eBay reserves the right to verify the eligibility of entrants. The Promotion begins at 00:00:01 BST on Thursday 24th November and finishes at 23:59:59 BST on Sunday 18th December 2005 ("Promotional Period").
In order to get into the Promotion pages, entrants will first need to enter their valid eBay User ID by clicking on the 'Now Pick Pressies' button on www.ebay.co.uk/stockingfiller.
Once entrants are in the Promotion pages, there are two ways to win a prize. One is by the instant win method (described in paragraph 12 below) and the other is by entry to the Daily Prize Draw (described below).
To enter the Daily Prize Draw to win a cash prize paid via PayPal: Entrants must do the following on www.ebay.co.uk ("eBay Site") during the Promotional Period:
Entrants may enter the Daily Prize Draw once for each item they buy and once for each item they list. There a limit of five "buy" and five "list" entries that entrants can make each day during the Promotional Period. Each combination of User ID and item number will only be a valid entry once during the Promotional Period. An item number for an item that is validly bought or listed during the Promotional Period may be used to enter the Daily Prize Draw on any day during the Promotional Period.
For scheduled listings, sellers may only enter the Daily Prize Draw after the item is live on the eBay Site during the Promotional Period.
No purchase necessary: In order to enter the Daily Prize Draw via the no purchase necessary route, the entrant must (a) go to the Promotion pages (b) click on the "Click here to enter" button on the "Win Your Christmas Pressies" area, (c) write the text "no purchase" in the "item number" box and (d) click on the "enter" button. Entry via the No Purchase Necessary route is limited to 5 entries per person, and not eBay User ID, per day. (Entrants do not need to make a purchase in order to win an instant win prize.)
The Daily Prize Draw prizes paid via PayPal: Entrants to the Daily Prize Draw are eligible to win prizes of £500, £1,000 and £2,000 up until the 18th December 2005 paid via PayPal. On the final day of the promotion, the Daily Prize Draw prize fund will consist of £500, £1,000 and £10,000 paid via PayPal. Entrants may only win one prize paid via PayPal per entrant and not per eBay User ID. The prizes paid via PayPal are not transferable. The prizes will only be paid via PayPal and no other method of payment to the winner shall be possible for this Promotion
A Daily Prize Draw will take place for each day during the Promotional Period from 25 November 2005. The three winners of the Daily Prize Draw will be the entrants whose names are selected by our systems at random from all the valid entries received by eBay on that day during the Promotional Period. The Daily Prize Draw will be conducted by an independently audited agency.
Once entrants have entered the Daily Prize Draw, their entries will be included in the draw for the day they enter. Entrants who win a cash prize will then be excluded from each subsequent Daily Prize Draw during the Promotional Period. Entrants who win a cash prize will not be excluded from the possibility of winning an instant win prize.
Winners of the Daily Prize Draw will be notified by telephone or email to the telephone number or email address provided to eBay within 10 working days of the draw taking place. The cash prizes will be deposited into each winner's PayPal account within 5 working days of notification.
To be eligible to win an instant win prize: Entrants will need to create a new Christmas list or amend an existing Christmas list by adding or removing items from it. Once any new list or change to an existing list has been saved, entrants will be notified by the eBay Christmas Elf if they have won a prize. Winners will need to follow the on-screen instructions to claim their prize. Entrants do not need to make a purchase in order to win an instant win prize. Entrants will have one chance to win an instant win prize per day.
Instant win prizes: The instant win prizes to be won each day during the Promotional Period are displayed on the prize page at http://www.ebay.co.uk/stockingfiller/prizes/index.html. Entrants may only win one instant win prize per entrant and not per eBay User ID. Instant win prizes are not transferable. If an entrant wins an instant win prize they will still be eligible to enter the Daily Prize Draw.
Winners of instant win prizes will be contacted by telephone or email to the telephone number or email address provided to eBay within 10 working days with further details of how to claim their prize. Winners will receive their instant win prize no later than 28 working days from notification.
Entrants shall be responsible for ensuring that the contact details associated with the eBay User ID they are entering with is up to date and accurate so they can be contacted if they win. If eBay or its authorised agents are not able to contact the winner by midnight 14 days after the first attempted notification, an alternative winner will be selected at random and the original winner's entitlement will lapse.
eBay may ask for proof from buyers to verify that they have paid for their item within 24 hours of the listing end (sufficient proof may include a PayPal payment receipt, a credit card receipt or other documentary evidence acceptable to eBay). eBay may also ask winners to provide proof of their age and/or country of residence.
A full list of prizes and winners' names and counties will be available by the end of the second week of January 2006 on the prize page at http://www.ebay.co.uk/stockingfiller/prizes/index.html.
If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
eBay may also disqualify any entrant that does not act in accordance with these terms and conditions or eBay's rules and policies.
Entries, lists and or prizes may be withdrawn by eBay from people using the Promotion in a way in which eBay deems inappropriate at its sole discretion.
Entrant's eBay account must be in good standing, including feedback not below zero with no overdue fees during this Promotion, from 23rd November 2005 until the delivery of the prize.
In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, change or cancel the Promotion, eBay reserves the right to suspend, change or cancel the Promotion at any time. This includes the ability to substitute any prize of equivalent value, change the specification of the prize if circumstances require it or change the entry methods.
eBay or the prize providers reserve the right to add additional terms and conditions for certain prizes awarded as a part of this Promotion.
English Law governs the Promotion. By entering, entrants agree to be bound by these terms and conditions and the eBay.co.uk User Agreement including without limitation Clauses 7.1, 7.2 and 7.3. The definition of "Your Information" in Clause 7.1 includes any information or content the entrant provides to eBay for the purposes of the Promotion. In particular you must not use any offensive or profane language when creating your lists. eBay reserves the right to disqualify any entrant who uses offensive or profane language.
eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
By entering, winners irrevocably grant eBay permission to use his or her name, likeness, biographical and eBay related information for advertising, promotional or publicity purposes, including on the prize winners page at http://www.ebay.co.uk/stockingfiller/prizes/index.html. The winner may also be required to sign a Publicity Release Form.
eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion or receipt of prizes.
Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotional Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion or the eBay site, including without limitation the accuracy of any Promotional Material.
Entrants may only win the prize applicable for the day of entry as advertised on the main prizes page accessible via www.eBay.co.uk and not any other prize that may be listed for any other day during the Promotion.
eBay may use third parties to facilitate one or more elements of this Promotion and we may provide some of your personally identifiable information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation.
