Terms and Conditions

1. This promotion is open to all UK and Republic of Ireland residents aged 18 years or over registered on any eBay site, except any employees (and their families) of eBay International A.G., any affiliates, subsidiary companies ("eBay"), any representatives or agents of those companies and anyone else who may be involved with the promotion. eBay reserves the right to verify the eligibility of entrants.



2. The promotion begins at 00:00:01 BST on Monday 5^th September and finishes at 23:59:59 BST on Sunday 18^th September 2005 ("Promotional Period"). 



3. To qualify for entry, entrants must do the following on www.ebay.co.uk or www.ebay.ie ("eBay Site") during the Promotional Period:

3.1 bid on and win an item in an auction-style listing or auction-style with Buy It Now (BIN) (excluding items bought via Multiple Item Listings) and pay for the item with PayPal within 24 hours of the end of the listing; or

3.2 buy an item with BIN (excluding items bought via multiple-item BIN listings) and pay for the item with PayPal within 24 hours of the end of the listing; or

3.3 list an item for sale (excluding Shops Inventory Format listings) without breaching eBay's Duplicate Listings policy

4. To enter, you must go the main landing page during the Promotional Period and enter the item number of the item you have bought or listed PLUS you must indicate whether you bought or listed by checking one of the tick boxes. You must then use your skill to select the 5 items from the eBay Treasure House that you believe to be the most valuable from the total of 20 items that are clickable on that day and click the submit button.



5. For scheduled listings, sellers may only enter after the item is live on the eBay Site during the Promotional Period.



6. On any day, the entrants who selects the 5 items from the eBay Treasure House with the highest combined value will be deemed the winner of the prizes applicable for the day of entry. Entrants that have the next highest combined value may be eligible for runners up prizes, if there are prizes for runners up on the applicable day. The winner and runners up will receive the prize or prizes applicable for that day as specified on the main prizes page.



7. The pre-determined value of each of the items in the eBay Treasure House is not based on actual winning bids for listed items and is not supposed to be an indication of the price that can be achieved for an item if listed for sale on eBay or if sold by other methods. Values have been determined in advance by an independent adjudicator based on his expert opinion as to the market value of the items. No correspondence will be entered into regarding the value of any item and the adjudicator's decision is final.



8. In the event of a tie-breaker (i.e. two or more entrants have chosen a winning combination of items), the winner will be the entrant who chooses the 5 items with the highest value in the shortest time, so you should make your selection as quickly as possible. The same process will apply for any runners up prizes.



9. Winners will be notified by telephone or email to the telephone number or email address provided to eBay within 7 days of the day of entry.



10. If eBay or its authorised agents are not able to contact the winner by midnight 7 days after the first attempted notification, eBay reserves the right to select an alternative winner and the original winner's entitlement will lapse.

12. eBay may ask for proof from buyers to verify that they have paid for their item within 24 hours of the listing end (sufficient proof may include a PayPal payment receipt, a credit card receipt or other documentary evidence acceptable to eBay).



13. Entrants may also have the opportunity to win certain other prizes that may be available in the eBay Treasure House by following the applicable instructions.



14. Entrants may enter once for each item bought or once for each item listed but may only win a maximum of one prize per day during this promotion. Only the first buy entry and the first sell entry for a particular item number will be counted. Subsequent entries for the same item number will not be eligible.



15. No cash alternatives or alternative prizes will be substituted for prizes.



16. A full list of prizes and winners names and county will be available within 5 days of the applicable prize day. Solutions and winners details (if possible) will also be posted on www.ebay.co.uk/treasurehouse/prizes.html



17. If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.



18. eBay may also disqualify any entrant that does not act in accordance with these terms and conditions or eBay's rules and policies.



19. Your eBay account must be in good standing, including feedback not below zero and no overdue fees during the period of this promotion, from 4 September 2005 until the delivery of the prize.



20. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, change or cancel the promotion, eBay reserves the right to suspend, change or cancel the promotion at any time. This includes the ability to substitute a prize of equivalent value, change the specification of the prize if circumstances require it or change the entry methods.



21. eBay or the prize providers reserve the right to add additional terms and conditions for certain prizes awarded as a part of this promotion.



22. English Law governs the promotion. By entering, entrants agree to be bound by these rules and the eBay.co.uk User Agreement including without limitation Clauses 7.1, 7.2 and 7.3. The definition of "Your Information" in Clause 7.1 includes any information or content the entrant provides to eBay for the purposes of the promotion.



23. eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.



24. By entering, winners irrevocably grant eBay permission to use his or her name, likeness, biographical and eBay related information for advertising, promotional or publicity purposes, including on the prize winners page at www.ebay.co.uk/treasurehouse/prizes.html. The winner may also be required to sign a Publicity Release Form.



25. eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the promotion.



26. Although eBay will use reasonable efforts to ensure that all information relating to the promotion ("Promotional Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the promotion or the eBay site, including without limitation the accuracy of any Promotional Material.



27. Entrants may only win the prize applicable for the day of entry as advertised on the main prizes page accessible via www.eBay.co.uk and not any other prize that may be listed for any other day during the promotion.



28. eBay may use third parties to facilitate one or more elements of this promotion and we may provide some of your personally identifiable information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation.
