The promotion
Every day during the promotion, which will last from Monday 6th December 2004 until Monday 3rd January 2005, there will be at least one free prize hidden on eBay.co.uk.
These prizes will be hidden throughout the site and will not necessarily be listed in their usual category. They will be able to be found by guessing the answers to clues which will be announced for each prize. Clues will be announced each day on the Christmas Treasure Hunt Home Page, at http://www.ebay.co.uk/treasurehunt, throughout the site and also by special announcements including in newspapers and on the radio.
The first person to find and "buy" the item will receive the prize. Each item will be offered by a different User ID. Whatever the apparent price of an item, its description will make clear that the prize winner will not be obliged to pay that price and the item will be free of charge.

The promotion is open to all UK residents aged 18 years or over registered on any eBay site, except any employees (and their families) of eBay International A.G., any affiliates, subsidiary companies ("eBay"), any representatives or agents of those companies and anyone else who may be involved with the promotion. eBay reserves the right to verify the eligibility of entrants.
In order to be eligible to win a prize, the winning entrant must be the first eBay user to find and commit to buy one of the items offered as a part of this promotion on eBay.co.uk.
Depending on the prize won, the winners may be able to be sent the item (which will be free of charge) or they might be responsible for collecting the prize from a London location. We aim to have all prizes ready for collection or delivery within 30 days from the end of the promotion, but for certain prizes this is subject to variation by the suppliers.
For any vehicles offered as a part of this promotion, they will be taxed for 12 months and have a full tank of petrol. The winner will be responsible for vehicle insurance and must provide full insurance details approximately two weeks prior to collection.
eBay will confirm the winners of each prize every day by either a telephone call or an email to the telephone number or email address supplied by the winner when they registered with eBay.
If eBay is not able to contact the winner by midnight seven days after eBay's first attempted notification, eBay reserves the right to relist the item and select an alternative winner and the original winner's entitlement to the prize will lapse.
eBay users may only win one prize each during this promotion.
Your eBay account must be in good standing, including feedback not below zero during the period of this promotion, from 6th December 2004 until 23:59:59 GMT 3 January 2005 or the delivery of the prize, if later.
No cash alternatives will be substituted for prizes.
eBay reserves the right to add additional terms and conditions for individual items offered for sale as a part of the promotion.
If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, change or cancel the promotion, eBay reserves the right to suspend, change or cancel the promotion at any time. This includes the ability to substitute a prize of equivalent value or change the specification of the Prize if circumstances require it.
English law governs the promotion. By entering, entrants agree to be bound by these rules and the eBay.co.uk User Agreement including without limitation Clauses 7.1, 7.1 and 7.3. The definition of "Your Information" in Clause 7.1 includes any information or content the entrant provides to eBay for the purposes of the promotion.
eBay shall not be liable, in contract or tort (including negligence) or for breach of statutory duty or in any other way, for any loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
By accepting a prize, the winner irrevocably grants eBay permission to use his or her name, likeness, biographical and eBay related information for advertising, promotional or publicity purposes. The winner may also be required to sign a Publicity Release Form.
eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the promotion.
eBay may use third parties to facilitate one or more elements of this promotion and therefore we may provide some of your personally identifiable information directly to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation. In these cases, you will be notified by eBay of the involvement of the internal service provider.

Entrants may only win "Today's Prize" as advertised on the main promotion landing page (http://pages.ebay.co.uk/treasurehunt/) and not any other prize that may be listed for any other day of the promotion.
Although eBay is using every effort to ensure that the release of prize listings, prizes, clues, hints and other information relating to the promotion ("Promotional Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the promotion or the eBay site, including without limitation the accuracy of any Promotional Material.
