Become a TV star Prize Draw - Terms and Conditions

The prize is the opportunity to feature in at least one TV advertisement and other campaign material in 2008, as one of the animated eBay Logo People. There is no cash alternative. The winner will be photographed and videoed to capture likeness, movement and personality during a photo shoot at a location in Richmond, Surrey (“Photo Shoot”). This will be the basis for the animators to create the winner as a 3D animated Logo Person (“Winner Logo Person”).

1. This TV Star promotion (“Promotion”) is open to all UK residents aged 18 years or over registered on eBay.co.uk (the “eBay site”), except any employees (and their families) of eBay International A.G., any affiliates, subsidiary companies ("eBay"), any representatives or agents of those companies and anyone else who may be professionally involved with the Promotion. The Promotion begins at 00:00:01 9th November 2007 and finishes at 12:59:59 18th November 2007 GMT (“Promotional Period”).
2. To enter the prize draw: To qualify for entry, entrants must do the following on the eBay site during the Promotional Period (each referred to as a “qualifying activity”):

1. bid on and win an item in an auction-style listing; or
2. buy an item with Buy It Now: or
3. list an item for sale without breaching eBay’s duplicate listings policy. For scheduled listings, sellers may only enter after the item is live on the eBay Site during the Promotional Period.

3. One prize draw entry per eBay account holder. You will be automatically entered into the Promotion when you complete a qualifying activity.
4. Your eBay account must be in good standing, including feedback not below zero and no overdue fees during Promotional Period and until the necessary photographs have been taken.  eBay reserves the right to verify the eligibility of entrants.
5. No purchase necessary: If you do not want to bid or buy anything on ebay.co.uk you can also enter the Promotion by sending your name and contact details to tvstar@ebay.com. The closing date and time for entries is 12:59:59 18th November 2007 GMT.
6. Opt out of entry: If you do not wish to be entered into the Promotion, please send an email to tvstar@ebay.com, which contains: a) the words “Opt-out of TV stars” in the subject box; b) your eBay User ID; and c) your request to opt out of the Promotion. 
7. To win a prize The winner will be the first entry selected by our systems at random from all the valid entries received by eBay during the Promotional Period. The prize draw will be conducted under the supervision of an independent observer.
8. The winner will be notified by telephone or email, to the current registered telephone number or email address provided to eBay, within 7 days following the end of the Promotional Period. 
9. Entrants shall be responsible for ensuring that the contact details associated with the eBay User ID they are entering with is up to date and accurate so they can be contacted if they win. If eBay or its authorised agents are not able to contact the winner by midnight 7 days after the first attempted notification, eBay reserves the right to select an alternative winner and the original winner’s entitlement will lapse.
10. The winner’s name and county will be available between 22/11/07 to 22/12/07 on this prize page at http://www.ebay.co.uk/tvstar.
11. In the event of a winner being unable or unwilling to accept the prize, they may nominate a family member or partner to accept the prize on their behalf (“nominated person”) by notifying eBay within 7 working days of eBay’s initial notification. The nominated person must have an eBay account and be over 18 years old.  If eBay consents to this, any reference to “entrant” and any reference to “winner”, below, shall include the nominated person.  The winner will be required to ensure that the nominated person attends the Photo Shoot and is notified of these terms and conditions. 
12. If the winner wishes to forgo the prize altogether, the winner must notify eBay within 7 working days of eBay’s initial notification. After the 7 day period has expired, eBay will conduct a new draw and an alternative winner will be selected.
13. The winner must be available for the Photo Shoot.  eBay will contact the selected winner and give them three dates to choose from (“date notification”).   If eBay does not receive notification from the winner, within 7 days of the date notification, confirming that the winner, as appropriate, will be attending the Photo Shoot on one of the three dates, the winner will forgo the prize, and eBay reserves the right to select an alternative winner. 
14. If the winner fails to attend the Photo Shoot on the date agreed between the parties, an alternative winner will be selected at random, and the original winner’s entitlement will lapse.   
15. The adjudicator’s decision is final in all cases and no communication will be entered into.
16. By accepting the prize, the winner irrevocably grants eBay permission to use his or her name, likeness, biographical and eBay related information for advertising, promotional or publicity purposes. The winner may also be required to sign a Publicity Release Form.
17. The Winner Logo Person remains at all times the property of eBay Inc. and the winner will not be granted any loyalties from its use. 
18. The winner shall have no input, creative or otherwise, in relation to the Winner Logo Person.  eBay will make all decisions regarding the final Winner Logo Person and the related development process. 
19. If eBay has suspicions or knowledge that any entrant/nominated person has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
20. eBay may also disqualify any entrant that does not act in accordance with these terms and conditions and/or eBay's rules and policies.
21. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it necessary to suspend, change or cancel the Promotion, eBay reserves the right to suspend, change or cancel the Promotion at any time. This includes the ability to substitute a prize, which is, in eBay’s reasonable opinion, of equivalent value, change the specification of the prize if circumstances require it or change the entry procedures from an online form to an email format.
22. English Law governs the Promotion. By entering, entrants agree to be bound by these rules and the eBay.co.uk User Agreement including without limitation Clauses 7.1, 7.2 and 7.3. The definition of "Your Information" in Clause 7.1 includes any information or content the entrant provides to eBay for the purposes of the Promotion.
23. eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
24. eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may effect entry to the Promotion.
25. Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotional Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion or the eBay site, including without limitation the accuracy of any Promotional Material.
26. eBay may use third parties to facilitate one or more elements of the Promotion and we may provide some of your personally identifiable information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation. 27. eBay International A.G. of Helvetiastrasse 15/17, 3005 Bern, Switzerland is the organiser of the Promotion. eBay may carry out this organisation through its local subsidiaries.
