eBay UK eBay x EFL – Carabao Cup Final Giveaway Terms and Conditions

The eBay UK eBay x EFL – Carabao Cup Final Giveaway (“Promotion Period”) will be open from 10:00:01am UK local time on 10th February until 11:59:59pm UK local time on 13th February (“Promotion Period”).

This Promotion is open to business users registered on eBay.co.uk (the “Site”) who are UK residents, and who must be 18 years of age or older. Employees (and their families) of eBay, affiliates, subsidiary companies, representatives or agents of those companies and anyone else who may be professionally involved with the Promotion are not eligible to enter.

In order to enter into the Promotion, you must, visit the online entry form and complete it to be entered into the Prize Draw during the Promotion Period (“Eligible Entries”).

Entrants will not receive any confirmation of their entry into the Promotion. They will be entered if they meet the eligibility criteria stated above and correctly follow the procedure stated in this section.

Only one entry per Seller ID is allowed.

The Prize Winners will be drawn at random on Tuesday 14th February from all of those who have opted into the Prize Draw.

The Prize will be two (2) tickets to the Carabao Cup Final and will be described in the Promotional Post and communicated to the Prize Winners on Tuesday 14th February. Tickets will be available for match day collection only from Wembley Stadium, and the winner must provide photo ID, or the tickets will not be released.

There is no cash alternative and the Prize cannot be transferred or exchanged. eBay and EFL reserves the right to substitute the Prize for one of its choosing which has a value the same or greater than the original Prize, in the event of circumstances outside its control making the prize unavailable. The Prize may be subject to availability and change where expressly stated.

The Prize Winner of any Prize which includes tickets is not permitted, by virtue of Section 166 of the Criminal Justice and Public Order Act 1998 to sell or otherwise dispose of the tickets to any other third party whatsoever, unless agreed by the eBay in writing.

Name changes are not permitted, unless expressly agreed in writing (at the sole discretion of the EFL and/or football club) on a case-by-case basis.

The Prize is for the applicable to the EFL Carabao Cup Final tickets only and does not include any other facilities of expenses whatsoever, such as (by way of example and all of which are the responsibility of the Prize Winner and/or their guest(s)) the following:

• travel to or from the venues and associated charges;
• accommodation;
• travel insurance;
• tips, gratuities, room service, drinks or meals; and
• any other costs associated with the trip.

There will be 10 Prize Winners who will be selected at random from all the Eligible Entries.

The following details are required from each Prize Winner and their guest:

• Name
• Date of birth
• Home address including postcode
• Email address
• Supporting team

If a Prize Winner and/or their guest(s) has any special accessibility requirements, the Prize Winner will need to make the eBay/EFL aware of this as soon as the Prize Winner has won a pair of tickets.  In some instances, notice of accessible seating may only be available at short notice. If wheelchair spaces are available, these will be offered on a first-come first -served basis.

The Prize Winner will be contacted via email, followed by a phone call on 14th February, in order to notify them of the Prize. If, despite eBay’s reasonable endeavours to do so, eBay cannot contact the Prize Winner, eBay reserves the right to select another Prize Winner among the Eligible Entries to award the Prize to.

eBay reserves the right to verify the eligibility of any of the Entrants.

In accordance with the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (CAP Code), the Prize Winner’s name and county of residence will be made available upon request to anyone who wishes to verify that a valid award took place. The Prize Winner has the opportunity to object to this information being published or made available, or to reduce the amount of information being made available. In order to object, please contact Customer Service.

Prize Winners are solely responsible to have all necessary information and documents in order to comply with any requirements relating to entry to the stadium or venue. Prize Winners must also comply with any other policies, guidance and instructions which may be provided to you by the EFL, football club and/or venue as applicable and may be updated from time to time, in relation to attendance at the match or event.

The Prize Winner and their guest attending a venue to enjoy their prize must also comply with all policies, rules and reasonable instructions provided by the EFL, venue operators and/or any authority at the venue. The EFL, the relevant venue operators and authorities reserve the right to remove any Entrant or Prize Winner (and/or their permitted guests) for failing to comply with those policies, rules or instructions or otherwise behaving in an inappropriate manner.

Any attempt to manipulate the Promotion is prohibited and will result in exclusion from participation.

If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants. eBay may also disqualify any entrant who does not act in accordance with these Terms and Conditions (or is acting in a way which contravenes the spirit and intention of these Terms and Conditions).

Your personal data will be processed in accordance with the eBay User Privacy Notice.

Your personal data will be used by eBay in connection with, and in order to determine the winner of, the Promotion (including making available on request the Prize Winner’s name and county of residence, to anyone who wishes to obtain it). eBay will do this on the basis of its legitimate interests in enabling eBay users to participate in prize draws. The EFL will be provided with information (including name and address) of the Prize Winners for prize administration and databases will be checked against any club banning orders as well as the National Police database for those who may be subject to a court banning order. The EFL will not otherwise use Prize Winners’ personal details for reasons other than the above, unless lawfully permitted to do so.

By submitting your personal information when entering the Prize draw, you acknowledge that eBay may disclose that information to the event organiser (EFL), venue host and/or the relevant football club(s) playing in the match to which the prize relate for the purpose of verifying your eligibility for any prize and or administering delivery of the prize.

Any personal data relating to Entrants will be kept securely and used solely for the purposes of administering this promotion and/or prize fulfillment by the promoter, EFL, clubs playing in the match to which the prize relate and/or by any agent of the promoter or EFL appointed to assist with running the promotion or administering the prize. eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any promotion.

eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay’s liability for death, personal injury or fraud.

These Terms and Conditions are governed by the laws of England and Wales. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under or in connection with these Terms and Conditions.

If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
