1. Promotion Period

The eBay UK Festive competition will be open from 10am UK local time on 4th December 2023 until 11.59pm UK local time on 18th December 2023.

2. Eligibility

This Promotion is open to users registered on eBay, who are UK residents, and who must be 18 years of age or older. Employees (and their families) of eBay, affiliates, subsidiary companies, representatives or agents of those companies and anyone else who may be professionally involved with the Promotion are not eligible to enter.

3. Procedure

In order to enter into the prize draw, you must purchase at least one listing from our competition landing page during the promotion period. Entrants will not receive any confirmation of their entry into the Promotion. They will be entered if they meet the eligibility criteria stated above and correctly follow the procedure stated in this section. Each new listing purchased counts as one entry in the Promotion. For example, if an eligible entrant purchases five new listings on the Site during the Promotional Period, they will have five entries into the Promotion.

4. Prize

Disney will provide the Promoter for the promotion eBay x Disneyland Paris (the “Promotion”) with one (1) package holiday consisting of two (2) night, three (3) day to Disneyland Paris for one (1) winner of the competition (Recipient) and three (3) accompanying guests, in total four (4) persons.

Return transport to Disneyland Paris, travelling by Eurostar in Standard class to Disneyland Paris from London St Pancras OR an economy class return flight from a selected regional airport to Paris Charles de Gaulle.
Return transfers between the Charles de Gaulle airport or Gare du Nord and Disneyland Paris.
Two (2) nights’ accommodation sharing one (1) standard room at a Disneyland Paris Hotel chosen by Disney (excluding Disneyland Hotel) for the Recipient and three accompanying guests, including continental breakfast.
Three (3) Day Park Hopper ticket per winner and accompanying guest valid for entry into the Disneyland Park and Walt Disney Studios Park.
Half board premium meal vouchers to cover lunch and dinner for four (4) people for the duration of the three (3) day trip.
The prize will be described in a Promotional Post and communicated to the Prize Winners within 30 days of the end of the Promotion Period. There is no cash alternative and the Prize cannot be transferred.

Please read the following information carefully:

Items not included which are the responsibility of the Recipient and accompanying guests include: UK transfers, alcoholic beverages, telephone charges, room service, laundry service, excursions, tips, souvenirs, and all other costs not otherwise mentioned herein.
The Prize is for the Recipient and up to three (3) guests of the Recipient’s choosing.
Travel insurance is not included. It is the Recipient’s and their guests’ responsibility to take out before travelling adequate insurance suitable for their needs for the entire duration of the Prize. Disney shall not be liable for any costs or losses through the Recipient’s failure to take out adequate insurance cover.
The holiday must be taken between 16th February 2024 and 30th September 2024. The booking form must be received back a minimum of 60 days before the travel dates.
The Recipient and all of their guests must travel at the same time on the same routing. Any children in the group must be accompanied by their parent/legal guardian aged 18 or over.
The Recipient and their guests are responsible for their own passport, visa requirements and any other documentation or any other requirements (including but not limited to Covid -19 testing) that may be imposed by the authorities from time to time.
It is the Recipient and their guests responsibility to comply with the applicable laws and follow the Foreign Commonwealth and Development Office’s travel advice in respect of Covid-19 which can be found at https://www.gov.uk/guidance/travel-advice-novel-coronavirus.
Age and height restrictions may apply to some attractions. Parks, attractions and/or entertainment may change operating hours or be closed due to refurbishing, capacity, weather or special events and may otherwise change or be discontinued without any notice and without liability to the Supplier.
The Prize and all elements within may not be sold, traded, transferred, rescheduled to dates not within the fulfilment period set forth above, or refunded.
The Supplier reserves the right to substitute elements of the Prize at any time or postpone the trip, including but not limited to due to closure of Disneyland Paris or any unavoidable and extraordinary circumstances.
There is no alternative prize and the Prize cannot be exchanged for cash or an alternative prize.
If the winner elects to partake in any or all portions of his/her prize with fewer than three (3) guests, the prize will be awarded to the winner and any participating guest and any remainder of the prize will be forfeited and shall not be subject to further or alternative compensation.
Enhanced health and safety measures will be/are in place at Disneyland Paris to promote cleanliness, physical distancing and reduced contact. Some experiences, shows or events may not be available or may be modified depending on the evolution of the safety and sanitary measures and recommendations from public authorities or other reasons, including but not limited to adverse weather conditions, refurbishment or maintenance. Disney, its parent, related, affiliated, and subsidiary companies and their respective officers, directors agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the Prize, the receipt, use and/or enjoyment of the Prize and/or the Promotion.

5. Prize Winner

There will be one Prize Winner who will be selected at random from all the Eligible Entries. Two runners up will also be randomly selected to win a £250 eBay voucher. Please read the following important information:

Vouchers will expire on 31st July 2024 11:59pm.
Vouchers can only be redeemed once
Vouchers can be used to pay for both ‘buy now’ & auction items
Vouchers must be redeemed on one purchase and cannot be split up
If the value of purchase falls below the voucher value, the difference will be lost

6. Prize Winner Notification

The Prize Winner will be contacted within 30 days of the end of the Promotion Period, in order to notify them of the Prize. If, despite eBay’s reasonable endeavours to do so, eBay cannot contact the Prize Winner, eBay reserves the right to select another Prize Winner among the Eligible Entries to award the Prize to.

eBay reserves the right to verify the eligibility of any of the entrants.

7. Prize Winner details

In accordance with the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (CAP Code), the Prize Winner’s name and county of residence will be made available upon request to anyone who wishes to verify that a valid award took place. 8. Exclusion From Participation

Any attempt to manipulate the Promotion is prohibited and will result in exclusion from participation.

If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.

eBay may also disqualify any entrant who does not act in accordance with these Terms and Conditions (or is acting in a way which contravenes the spirit and intention of these Terms and Conditions).

9. Data Use and Data Privacy

Your personal data will be processed in accordance with the eBay User Privacy Notice.

Your personal data will be used by eBay in connection with, and in order to determine the winner of, the Promotion (including making available on request the Prize Winner’s name and county of residence, to anyone who wishes to obtain it). eBay will do this on the basis of its legitimate interests in enabling eBay users to participate in prize draws. Your personal data will be processed in accordance with both the eBay privacy policy mentioned above, as well as The Walt Disney privacy policy.

10. Limitation of liability

eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any promotion.

eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.

eBay will not be responsible for any third party's performance or failure to perform any services related to any promotion, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.

eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion.

Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotion Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion, including without limitation the accuracy of any Promotion Material.

11. General

eBay reserves the right to suspend, change or cancel this Promotion at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this Promotion. This includes the ability to substitute a prize, which is, in eBay’s reasonable opinion, of equivalent value, change the specification of the prize if circumstances require it or change the entry procedures to an email format.

The decision of the adjudicator regarding any aspect of this Promotion is final and no correspondence will be entered into.

eBay may use third parties to facilitate one or more elements of the Promotion. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation. These Terms and Conditions are governed by the laws of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under or in connection with these Terms and Conditions.
