1. About the Pay on Behalf Service

The eBay Pay on Behalf (“PoB”) Service helps you comply with Italian EPR requirements. eBay may calculate eco-fees, submit reporting to PROs, and pay eco-fees on your behalf. By enrolling, you authorize eBay to act on your behalf. You only need to accept these Terms once. They apply across all categories, including those you enroll in later.

2. Who the Service Applies To

The service applies to business sellers selling products into Italy that are in scope under applicable EPR law. eBay may define which sellers, categories, and transactions are supported. Initial categories may include packaging, tyres, polyethylene, electronics, and batteries. The scope may change over time based on legal or operational requirements.

3. How the Service Works

eBay uses your listing and transaction data to calculate eco-fees and reporting. This may include category mapping, product attributes, seller data, and estimates where needed. eBay may use reasonable assumptions when exact data is unavailable.

4. Important Exceptions

For packaging, EPR obligations apply only to sellers who sell products into Italy from outside Italy (cross-border sellers), in accordance with applicable law. Sellers that qualify as micro-enterprises may be exempt from these obligations. eBay does not verify whether packaging obligations apply to you or whether an exemption is applicable. You are responsible for determining your status.  If you opt in despite being exempt, eBay may still calculate and pay eco-fees.

5. Your Responsibilities

You must provide accurate and up-to-date information, including EPR/RENAP IDs. You must list products in the correct categories and provide accurate attributes. eBay relies on your data and does not verify it. You remain responsible for errors or omissions.

6. Fees and Charges

The PoB Service is a chargeable service, although eBay is currently offering it to sellers free of charge for the launch period. This means that, at this time and until further notice,  you are not required to pay any fee for the PoB Service. eBay may decide to apply charges to the PoB Service in the future. Should eBay do so, it will notify you in advance in accordance with the eBay User Agreement, including through the communication channels and notice mechanisms described there. Any charges may be based on or influenced by legal and regulatory requirements and/or eBay’s agreements or arrangements with compliance schemes.

7. Duration and Opt-Out

Participation starts when you enroll and continues until you opt out, unless otherwise notified by eBay to you. If you opt out, it takes effect at quarter end. eBay may still calculate eco-fees for sales made while you were enrolled.

8. Legal and Compliance

These Terms apply alongside eBay policies. eBay may update the PoB Service and these Terms, including when introducing charges for the service in the future. You remain responsible for legal compliance outside this service. You authorize data sharing with PROs and authorities and you must keep records and cooperate with audits.
