Seller Terms & Conditions

The eBay International Shipping programme (“EIS” or “Programme”) makes certain items (“EIS Item(s)”) that you, the seller ("you", "Seller") list for sale on eBay.co.uk available to buyers outside of the United Kingdom (“Buyers”). EIS enables Buyers to obtain parcel processing, international shipping, and customs clearance services (the “Services”) at checkout. It is facilitated by eBay Marketplaces GmbH (“eBay”, "we", "us", "our") through third party service providers including technology providers, hub operations facilities and carriers that eBay has contracted with to operationalise the Services.

When a Buyer purchases an EIS Item from you, your Buyer will be entering into a binding contract with you for the purchase of the EIS Item, as well as an agreement with eBay for the provision of the Services. You acknowledge and agree that these eBay International Shipping programme Seller Terms and Conditions (“Terms”) apply to you as well as any EIS Items that Buyers purchase from you through the Programme. By participating in, or not opting out of, the Programme and by creating, maintaining or revising eligible listings, you agree that these Terms apply to you and to all of your eligible new listings and existing listings.

1. Applicability of eBay User Agreement.

The eBay.co.uk User AgreementeBay’s User Privacy Notice and all policies posted on our sites, including the International Selling Policy (collectively, and as the same may be amended from time to time, “eBay’s Policies”) apply in addition to these Terms. In the event of a conflict or inconsistency between these Terms and eBay’s Policies, these Terms will control as to all matters that they explicitly address. For all matters not explicitly addressed by these Terms, eBay’s Policies will control.

2. Your Relationship with eBay for the Services.

  1. Services. You authorise eBay and third party service providers to provide the following Services in connection with your sale of EIS Items to Buyers:
     
    1. Eligibility: eBay will determine, in its sole discretion and using the information that Sellers provide to it, which (A) items are eligible for export (B) items are eligible for import and (C) Sellers are eligible for the Programme.
       
    2. Parcel processing service: after your Buyer has paid for the EIS Item, you will ship the EIS Item to a parcel processing facility located in the United Kingdom (“UK Shipping Hub”), which is managed by third party service providers. Third party service providers will oversee the processing of the EIS Item at the UK Shipping Hub in preparation for international shipping to your Buyer. eBay or its third party service providers may open and inspect the EIS Item without notice (including for the purposes of the acceptance process at Section 5a) and may repackage improperly packaged EIS Items. The EIS Item will then be routed through the carrier’s networks.
       
    3. International shipping and tracking service: eBay will arrange for the international shipping of the EIS Item from the UK Shipping Hub to the Buyer’s delivery address provided by the Buyer (or to a collection centre near your Buyer designated by the carrier) ("Delivery Location").
       
    4. Customs service for shipments: For export control purposes, as the Seller, you are the exporter and remain responsible for all export reporting obligations under applicable law (including but not limited to the Export Control Act 2002). eBay, by itself or through third party service providers will facilitate the export on your behalf (on an indirect customs representation basis) and perform import clearance of EIS Items on behalf of the Buyer. eBay, and the third party service providers, have been authorised by you and your Buyer to: (a) deal with customs business with all relevant customs and revenue authorities on your behalf, (b) remit any import charges to applicable authorities, (c) make export classifications and export filings, (d) make all declarations (including declarations of value) and filings in connection with the export of the EIS Item from the UK and the import of the EIS Item into the country into which it is being imported, (e) select and amend country of origin (“COO”) or product and service codes and Harmonised System Codes or such commodity classification codes as shall be applicable, (f) determine export classification codes, (g) manage any disputes with such authorities as appropriate and (h) do any other act that may be necessary in connection with the exportation or importation of an EIS Item. eBay will be responsible for preparing and sending any documents or records to be filed for the sale and export of EIS Items on your behalf and you, as the exporter, will be responsible for providing full and accurate information to enable eBay and its service providers to perform the Services.
       
    5. Customs representative. You appoint eBay’s designated third party service providers, including any carrier or customs broker used for the Programme, to act as your indirect customs representative for the purpose of making export declarations and dealing with export customs formalities for EIS Items. Such indirect representative may use its own EORI number and customs authorisations when submitting export declarations on your behalf.
       
    6. Extended Producer Responsibility. Where applicable, you authorise eBay and/or its affiliates to act as your authorised representative for the limited purpose of supporting or fulfilling Extended Producer Responsibility requirements in respect of your EIS Items, including associated reporting obligations. You remain responsible for providing complete and accurate information reasonably required for such compliance and for any EPR obligations, fees or charges that remain your responsibility under applicable law, unless eBay expressly agrees otherwise.
       
  2. Data Protection.  In connection with the Programme, eBay processes personal data in accordance with the eBay Privacy Notice that applies to your use of the eBay.co.uk website. In order for eBay to provide you with the Services under the Programme, eBay processes certain personal data in addition to your order information, including, but not limited to: your name, user ID, address, email address, telephone number and, where applicable, tax ID (e.g., economic operators registration and identification number). You are responsible for the accuracy of this information and, where personal data relating to another individual is provided, acknowledge that you are authorised to provide this information for the purpose of delivering your EIS Item to your Buyer. eBay may disclose this information, however collected, to its affiliates, the third party service providers (e.g., shipping carriers and custom brokers), and other third parties (such as customs and revenue authorities) as necessary to perform the Services (for example, providing your name and address information to customs brokers and shipping carriers so that they may clear customs and deliver your order). eBay, its affiliates, and/or its third party service providers may contact you directly in order to collect or confirm certain personal data and/or order information necessary for the performance of the Services.  Any processing of personal data by third party service providers or other third parties in connection with the Services is subject to their applicable privacy policy or notice. To the extent these third parties process personal data in their own right in connection with the Services, they act as independent data controllers in respect of that processing.

3. Eligibility.

  1. Item Eligibility. Not all listings on eBay.co.uk are eligible for the Programme. eBay may, at any time and in its sole discretion, alter or amend the eligibility requirements for EIS Items without notice. You agree not to sell any ineligible items through the Programme which shall include, but not be limited to, the ineligible items listed here. You agree that eBay shall have the right to decide if the EIS Item is eligible for the Programme. You agree that in respect of any items found to be ineligible Section 8.b (Undeliverable Items) will apply.
  2. Country Eligibility. The Programme is not available for shipments to all countries. The Delivery Location specified by your Buyer must be in a country eligible for the Programme. eBay reserves the right, in its sole discretion, to expand or limit the countries eligible for the Programme at any time, without notice. Where eBay expands the list of countries eligible for the Programme, (i) all EIS Items will automatically be made available to Buyers in the additional countries and (ii) your existing, live listings that offer EIS Items will be automatically updated to permit sales to Buyers in the additional countries. The countries currently eligible for the Programme may be found here. If eBay determines that one or more of your listings is eligible for sale to certain countries, but not to certain other countries, you authorise eBay to exclude the listing from being available to Buyers in just those ineligible countries.
  3. Member Eligibility and Participation Limits. You must be a UK resident or established in the UK and your items must be shipping from within the UK. eBay may also require that you meet certain minimum performance standards (as may be amended from time to time) before making your listings available to Buyers through the Programme. EIS Items dispatched from Northern Ireland will be routed through the UK Shipping Hub in Great Britain for international shipment. Additional requirements may apply to such EIS Items under the Windsor Framework and related customs, product compliance and trade laws. eBay may restrict, suspend or exclude such listings from the Programme where necessary to comply with those requirements.
  4. Programme Rules. You will comply with the following rules for any EIS Items that you sell through the Programme (noting that a failure to comply with these rules will entitle eBay, in its sole discretion, to remove your access to the Programme):
    1. Upon eBay’s notice that the Buyer has paid for an item, you will ship within your handling time the EIS Item(s) to the UK Shipping Hub address provided to you in accordance with your listing;
    2. You will package all EIS Items appropriately, and in accordance with correct weight and dimension limits, as follows:
      • Nothing greater than 31.5kg billable weight (not actual weight);
      • The maximum weight applies to the packaged item; and
      • Packages exceeding 120cm in length (120cm x 60cm x 60cm) are not permitted;
    3. You will properly prepare, package and ship allowable dangerous goods according to the relevant regulations including but not limited to the ADR and the IATA Dangerous Goods Regulations;
    4. You will ensure that lithium battery devices are secured in rigid packaging to prevent movement and accidental activation. For the avoidance of doubt, rigid packaging includes boxes, hard shell plastic, and the original manufacturer packaging. Poly mailers, shrink wrap, and other types of non-rigid packaging are prohibited;
    5. You will ensure the accuracy of your item’s country of origin and the item’s country of manufacture in your listing, as applicable, and maintain any required certificate of origin, including any required certificate of origin for preferential treatment claims or otherwise;
    6. You will ship all EIS Items contained in a single order to the UK Shipping Hub in one package;
    7. You will not combine multiple orders in a single package;
    8. If a single order requires multiple packages, each package requires a separate, unique label; and
    9. You will not use the Programme to sell ineligible items or items that you are obligated not to sell outside the UK and/or apply country exclusions for items that cannot be sold to aforesaid countries and that for other reasons you do not wish to ship or are obligated not to sell to specific regions outside the UK. You further warrant that any limitation or restriction of countries or regions to which you authorise export of your product(s) is in no way related to your participation in an unlawful boycott prohibited by UK or other applicable laws.

 

4. Compliance with Applicable Laws.

You agree not to sell or export any EIS Items through the Programme in violation of any applicable laws or regulations including export regulations, international labour standards and applicable labour laws and regulations. Where necessary, you are responsible for appointing an economic operator in the European Union for product safety obligations. By not opting out of the Programme, you are representing and warranting that your sale, transfer, export or import of the EIS Item does not violate any applicable laws or regulations and that you as a Seller have taken all necessary steps to ensure you are in the position to export items outside of the United Kingdom including where applicable, obtaining an EORI number for export. You are responsible for ensuring that your sale and exportation of the EIS Items complies with all laws, regulations and requirements of the country from which it is being exported and in which it is being sold. You will provide to eBay all necessary information required by it regarding the EIS Items sold. You represent and warrant that no EIS Item requires an export licence, trade sanctions licence, import licence, permit, certificate, end-use undertaking or other government authorisation for export from the United Kingdom or import into the Buyer’s destination country.

You agree to comply with all applicable export control and sanctions laws, statutes, and regulations in your compliance with these Terms, including but not limited to the requirements of the Export Control Act 2002, Export Control Order 2008, Assimilated Council Regulation (EC) No 428/2009, Assimilated Regulation (EU) 2019/125 and the Sanctions and Anti-Money Laundering Act 2018. This includes but is not limited to you refraining from sourcing or selling any items from or to: (i) countries subject to a comprehensive embargo by the UK government including, for purposes of these Terms, Iran, Syria, Russia, Belarus,  North Korea, the non-government controlled territories of Ukraine, including Crimea (along with Sevastopol), and the non-government controlled areas of the Donetsk, Luhansk, Kherson and Zaporizhzhia oblasts; (ii) any person or entity located in, or entity owned by an entity located in, any destination subject to comprehensive sanctions, trade embargoes, territory-wide restrictions or other UK trade restrictions; (iii) any person or entity, designated or specified on the UK Sanctions List published by the Foreign, Commonwealth & Development Office, any person or entity owned or controlled by such person or entity, any entity subject to UK Russia financial or investment restrictions, or any other applicable sanctions, export-control, trade-restriction or restricted-party list, notice, regulation or guidance issued by His Majesty’s Government, including by HM Treasury, OFSI, the Department for Business and Trade, the Export Control Joint Unit, HMRC or the Office of Trade Sanctions Implementation. This section will apply regardless of the legality of such a transaction under local law.

5. Risk of Loss.

For purposes of the Programme:

  1. you remain responsible for loss of, or damage to, an EIS Item (including under the eBay Money Back Guarantee pursuant to Section 8) until it is accepted at the UK Shipping Hub. An item shall only be treated as accepted by the UK Shipping Hub when:
    1. it has been accepted by the UK Shipping Hub; and
    2. the applicable processing and eligibility checks have been completed (including to verify that the EIS Item does not fall into one of the categories of damaged or undeliverable items set out at Section 8a).
       
  2. Once the EIS Item has been accepted as described in Section 5a, you will not be responsible under the Programme for loss of or damage to the EIS Item during onward international shipping, except to the extent caused by:
     
    1. your breach of these Terms and / or eBay's Policies;
       
    2. inaccurate, misleading, untimely or incomplete information provided by you;
       
    3. inadequate or inappropriate packaging; or
       
    4. prohibited or restricted items, counterfeit goods or other loss, theft or damage caused by an act of omission by you.

Nothing in this Section affects any mandatory rights that a Buyer may have under applicable law.

6. Transfer of Title.

  1. Subject to Section 6b and Section 6c, title to an EIS Item remains with you until such time that the EIS Item is successfully delivered to your Buyer, at which time title to the EIS Item shall transfer to your Buyer.
     
  2. If the EIS Item is undeliverable, title will transfer automatically from you to eBay’s third party service provider in accordance with Section 8b.
     
  3. Save for the aforesaid, at no time does eBay (or its affiliates) or the third party service providers, or other subcontractors under contract with eBay or its third party service providers’ subcontractors take title to an EIS Item, unless explicitly stated.

7. Payment Reversals.

If eBay or eBay’s third party service providers determine, after your Buyer has purchased an EIS Item, that the EIS Item is ineligible for the Programme or cannot be sent to your Buyer (for whatever reason), eBay and its affiliates shall have the right to cancel your sale of the EIS Item in lieu of proceeding with the processing and/or shipment of the EIS Item and, upon exercising this right, shall have the right to reverse the payment that your Buyer made to you for the EIS Item. In such cases, eBay will process the EIS Item as an undeliverable item. Where eBay liquidates or destroys the item (or arranges for such through its third party service providers), the payment will not be reversed.

8. Lost, Damaged, or Undeliverable Items.

  1. eBay Money Back Guarantee. EIS Items purchased by your Buyer (and sent to your Buyer’s specified delivery address or a collection centre near your Buyer designated by the shipping carrier) may be covered by an eBay Money Back Guarantee in countries without eBay Money Back Guarantee.

In general, you will be responsible (under the eBay Money Back Guarantee) for the loss of, or damage to, an EIS Item until it is accepted at the UK Shipping Hub in accordance with these Terms, unless your EIS Item has been sent using a Simple Delivery label, in which case the eBay delivery terms and conditions will apply. For example, you will be held responsible for eBay Money Back Guarantee cases or other disputes where eBay finds that:

  1. The EIS Item that you sold was not received at the UK Shipping Hub.
     
  2. The EIS Item that you sold was noted as damaged by the domestic carrier when received at the UK Shipping Hub.
     
  3. The EIS Item that you sold was found to be damaged upon opening after receipt thereof at the UK Shipping Hub.
     
  4. A parcel contains the wrong or no EIS Item associated with the Buyer’s order, or where the EIS Item is deemed counterfeit.
     
  5. One or more of the following pieces of information provided by you is incorrect or indeterminable (and it is not practicable for eBay or its service providers to correct):
    • Country of Manufacture/Country of Origin
    • Item Category
    • Item title
    • Item condition
    • Weight of parcel
    • Dimensions of parcel
    • A parcel is oversized and/or overweight and cannot be sent through an upgraded service.
    • The EIS Item that you sold requires destruction (e.g., contraband).
       
  6. The EIS Item is restricted or prohibited for export or import into the relevant country.

You will not be responsible under the eBay Money Back Guarantee for the loss of, or damage to, an EIS Item after it passes the UK Shipping Hub checks and is accepted at the UK Shipping Hub.
 

  1. Undeliverable Items.

eBay shall have no liability for EIS Items that are undeliverable to the Buyer or which are rejected by the UK Shipping Hub in accordance with Section 5a. In such circumstances, eBay may, dispose of or liquidate EIS Items that are undeliverable or which are rejected by the UK Shipping Hub, for whatever reason.

   c.      If, in such circumstances, the relevant EIS Item will be liquidated or disposed of, title will transfer automatically from you to eBay’s third party service provider and you will keep your Buyer’s payment. You hereby irrevocably appoint eBay as your agent solely for the purpose of effecting that transfer of title and taking any action reasonably required for such.

You acknowledge that allowing you to retain your Buyer’s payment for the EIS Item is sufficient consideration for the transfer of title to any third party service provider or the disposal of your EIS Item.

9. International Returns.

To the extent permitted by applicable law, eBay may choose not to display the returns policy field of your listings to Buyers. For international returns your item will be returned to a third party service provider or liquidated  and you will keep your sale proceeds.

10. International Selling Options.

  1. Opt-Out.

You may opt out of the Programme at an account level by adjusting your account settings within My eBay. Your opt out may take up to 72 hours to process and will not apply to any existing listings restricted from revision (including where there are pending bids or a pending best offer).
 

  1. Country Exclusion Lists.

You’re in control of where your items ship. You can also opt out of shipping your EIS Items to certain countries. We provide you with a toggle button in your My eBay settings to allow you to sync your EIS listings with your excluded locations. If you do not currently have an exclusion list in place and wish to create one, you can update your account settings within My eBay to restrict international buyers from purchasing your items. If you have any items listed on eBay.co.uk that, for whatever reason, you suspect cannot lawfully post or import to a country eligible under the Programme, then you should restrict international buyers in that country from purchasing your items by creating and applying an exclusion list within My eBay.

 

  1. Non-EIS shipments

If you offer an independent international shipping option that is in addition to the “eBay International Shipping” option, and the buyer selects your independent international shipping option when completing the transaction, the transaction will automatically fall outside EIS and neither you nor the buyer will be eligible for any of the EIS services or benefits.

11. Disclaimers and Liability.

  1. The Services are provided by eBay and its third party service providers. Subject to Section 11f, eBay expressly disclaims to the extent permitted by law all express, implied, and statutory representations, warranties, and conditions relating to the Programme and/or Services, including, but not limited to, warranties regarding the security, reliability, timeliness, usefulness, performance, accuracy, or quality of the Programme and/or Services.
     
  2. Subject to Section 11f, eBay will not be responsible for any disruptions or delays in the use of the Programme and/or Services or in the performance or delivery of Services or any loss or injury associated with any such disruption or delay.
     
  3. Subject to Section 11f, eBay (including our subsidiaries, affiliates, joint ventures, directors, officers, agents and employees) shall not be liable to you in contract, tort (including negligence), statute or otherwise for any:
    1. business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption;
    2. any losses which are not reasonably foreseeable by us (or our subsidiaries, affiliates, joint ventures, directors, officers, agents and employees) arising, directly or indirectly in connection with these Terms;
    3. acts or omissions of Buyers;
    4. losses arising from your use of, misuse of, or reliance on the Programme and/or the Services, or your inability to use the Programme and/or the Services; or
       
    5. loss or damage to the EIS Items sold under the Programme.
  4. Subject to Sections 11a to 11c (inclusive) and Section 11f, eBay's (and our subsidiaries, affiliates, joint ventures, directors, officers, agents and employees') liability to you or to any third party is limited to the greater of (a) any amounts due under the eBay Money Back Guarantee up to the price the EIS Item sold for on eBay and its original postage costs, or (b) £100.
     
  5. Compensation. You are responsible for, and will reimburse eBay, its affiliates and service providers for, losses, duties, taxes, charges, penalties, fines, storage, handling, return, destruction, disposal and reasonable legal costs incurred to the extent arising from your breach of these Terms, inaccurate or incomplete information provided by you, your sale of prohibited or restricted items, or your violation of applicable law, except to the extent caused by eBay’s breach of these Terms, negligence or wilful misconduct.
     
  6. Nothing in these Terms shall limit or exclude eBay’s liability for fraudulent misrepresentation, for death or personal injury resulting from our or our third party service providers’ negligence or the negligence of our or our service providers’ agents or employees, or for any other liability that cannot be limited or excluded by law.

12. Events Outside Our Control.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and/or an order that is caused by an event outside our control. This may include (but not be limited to) any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, theft, a pandemic or failure of public or private telecommunications networks, suspension of any third party site, or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

13. Other Terms.

  1. No agency, partnership, joint venture, employment or franchise relationship is created between you and eBay, except to the limited extent expressly set out in these Terms.
     
  2. Except as otherwise provided herein, these Terms are the entire agreement between you and eBay with respect to the Programme. eBay's failure to enforce any provision of these Terms will not be construed as a waiver of any provision or right.
     
  3. If any provision of these Terms is held to be invalid, void or for any reason unenforceable, such provision shall be struck out and shall not affect the validity and enforceability of the remaining provisions.
     
  4. Unless otherwise provided in these Terms, these Terms do not provide any rights or benefits to any third party.
     
  5. We may at any time, in our sole discretion, with or without notice to you (save as expressly provided herein):
    1. amend, replace, suspend temporarily, and/or discontinue permanently, the Programme, its name, any of the Services, features, and/or functionality offered under the Programme, and/or the service providers used to provide the Services; and/or
    2. limit, prohibit, refuse, cancel, block, suspend and/or terminate your sale of EIS Items through the Programme if we determine that you violated any of these Terms, our policies, or any applicable laws.
       
  6. These Terms may be amended at any time by email, or via the Messages section of My eBay or by posting the amended terms on eBay.co.uk. All amended terms shall automatically be effective 15 days after they are initially posted. Your continued use of the Services after the effective date of these amended Terms constitutes your acceptance of them.
     
  7. Termination or expiry of these Terms shall not affect any rights, remedies, obligations or liabilities of eBay or you that have accrued up to the date of termination or expiry. Any provision of these Terms which expressly or impliedly is intended to come into or continue in force on or after termination or expiry shall continue in full force and effect, including but not limited to Section 2a, Section 2.b, Section 4, Section 6, Section 7, Section 8 and Section 11.
     
  8.  These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction.
