The organiser of the mobile prize draw ("Prize Draw") is eBay Europe S.à r.l., 22-24 Boulevard Royal, L-2449 Luxembourg, www.ebay.co.uk (hereinafter, "eBay" or "we").
All residents of the United Kingdom (excluding Northern Ireland) who are 18 years of age or older at the time of entry, who have been selected for this Prize Draw, have received an e-mail on behalf of eBay inviting them to participate ("Participation Email") and have subsequently purchased an item on the eBay.co.uk mobile web or via an eBay app are eligible for the Prize Draw. Employees (and their families) of eBay, affiliates, subsidiary companies, representatives or agents of those companies and anyone else who may have be professionally involved with the Prize Draw are not eligible to enter.
Please note: only the original recipients of the Participation Email will be eligible for the Prize Draw. If you did not receive the Participation Email, but still purchased an item on the mobile web or via an eBay app, you will not be entered into the Prize Draw.
The Prize Draw will be open from 00:00:01 GMT on the 19 February 2013 until 23:59:59 GMT on the 28 February 2013 ("Prize Draw Period"). Any purchases made on the mobile web or via the eBay app after the end of the Prize Draw Period will not be eligible. There will be a draw for Eligible Entries made for each day of the Prize Draw Period. This means that there will be a total of 10 prize drawings with 10 different winners, 1 winner per day. All 10 prize drawings will be made after the Prize Draw Period has ended.
To enter:
You may only make one Eligible Entry per day within the Prize Draw Period. For the avoidance of doubt, if you enter on multiple days, you may only win the £1,000 PayPal credit prize once. In addition, if you make several Eligible Entries in one day, only your first Eligible Entry will be entered into the Prize Draw.
If you do not wish to be entered into the Prize Draw, please send an email to mobilecompetition@ebay.com which contains: a) the words "Opt-out of the Mobile Prize Draw" in the subject box; b) your eBay User ID; and c) your request to opt out of the Prize Draw.
The prize winners ("Winners") will be the first name drawn randomly after the 28 February 2013 and on or before 5 March 2013. There will be a draw for Eligible Entries made for each day of the Prize Draw Period. This means that there will be a total of ten prize drawings with ten winners, 1 winner per day. All ten prize drawings will be made after the Prize Draw Period has expired. There will be a Winner for each day of the Prize Draw Period.
The prize of the competition is £1,000 credited to each Winner's PayPal account ("Prize") during March 2013. The Prize will be credited to the PayPal account associated with the Winner's eBay account on 5 March 2013. In the case of multiple PayPal accounts associated with one eBay account, the Winner will receive an email on 5 March 2013 asking them to indicate the preferred PayPal account to which the Prize will be disbursed. Shortly after the Winner has provided their preferred PayPal account, the Prize will be credited into that account. There is no alternative compensation and the Prize is not transferable.
The Winners will be notified by email on 5 March 2013. The notification will be sent to the same e-mail account in which the Winner received the Participation Email. We are not obligated to investigate further when a notification is undeliverable. The participants who did not win a Prize will be informed via email on 5 March 2013.
eBay reserves the right to verify the eligibility of entrants and their identity.
The Winners may be required to provide proof that he or she is the authorised account holder of the PayPal account to which the Prize will be disbursed. In the event of a dispute regarding an online submission, the entry will be deemed submitted by the authorised account holder. "Authorised account holder" means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or organisation (e.g., business, educational, institutional) that is responsible for assigning e-mail addresses for the domain associated with such e-mail address.
If your PayPal account is or becomes blocked, closed or restricted for any reason during or shortly after the Prize Draw Period, you may be excluded from participating in the Prize Draw. In this event, eBay reserves the right to draw another Winner.
You can write to eBay after 5 March 2013 to request the names of the Winners. To do so, please write to mobilecompetition@ebay.com.
It is your sole responsibility to notify eBay in writing if you change your e-mail address during the Prize Draw Period. To do so, please write to mobilecompetition@ebay.com.
Any attempt to manipulate the Prize Draw is prohibited and will result in exclusion from participation.
If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
eBay reserves the right to disqualify participants who do not comply with these Terms and Conditions or with the eBay User Agreement (https://pages.ebay.co.uk/help/policies/user-agreement.html?rt=nc )and/or any other eBay policies.
The official rules of the Prize Draw are contained in this document. By participating, entrants accept these Official Rules and understand that the results of the Prize Draw are final in all respects. All decisions regarding any aspect of this Prize Draw including, but not limited to, Winner selection, will be made by eBay, whose decisions shall be final and binding in all respects and no discussion will be entered into. Any entries not complying with these official rules will not be accepted and will not participate in the Prize Draw.
eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any Prize Draw.
eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Prize Draw. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
eBay will not be responsible for any third party's performance or failure to perform any services related to any Prize Draw, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Prize Draw, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.
eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Prize Draw.
Although eBay will use reasonable efforts to ensure that all information relating to the Prize Draw ("Prize Draw Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Prize Draw or the site, including without limitation the accuracy of any Prize Draw Material.
eBay may use third parties to facilitate one or more elements of the Prize Draw and we may provide some of your personal information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the personal information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation. By entering the Prize Draw, you agree and consent to eBay co-operating with PayPal for the sole purpose of crediting your PayPal account in the event you win a Prize.
eBay reserves the right to suspend, change or cancel this contest at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this contest.
eBay may carry out this Prize Draw through its local subsidiaries. eBay may use third parties to facilitate one or more elements of the Prize Draw and we may provide some of your personal information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation.
These Terms and Conditions are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these terms and conditions.
