These eBay Policy Education Programme Terms and Conditions (“T&Cs”) apply to the eBay Policy Education Programme (“Programme”) on the eBay.co.uk site (“Site”), whereby selected sellers (“You” and “Your”) may receive proactive 1:1 educational support from eBay regarding policy-related selling activity.
For the purposes of these T&Cs, “eBay” means eBay (UK) Limited and its group companies.
1. Programme Eligibility
- The Programme is open to business sellers who:
- are registered on the Site; and
- have been selected by eBay based on internal eligibility criteria.
- Participation is linked to the eBay user ID selected and is not transferable.
2. Procedure
- Sellers are enrolled automatically and assigned an internal eBay marketplace advisor who will provide 1:1 educational outreach.
- The duration of your participation is determined in agreement with your assigned eBay marketplace advisor, based on the nature and extent of support required.
- By remaining enrolled, you are accepting the terms outlined below. By accepting, You agree to comply with these T&Cs, and eBay’s User Agreement, User Privacy Notice and Policies (collectively, "eBay Policies").
3. Programme Term
- The Programme begins on 12 August 2025 and will continue until suspended, modified, or terminated by eBay.
- Your individual enrollment period will be agreed between You and your assigned marketplace advisor. eBay reserves the right to remove sellers from the Programme at its sole discretion.
4. Description of the Programme
- The Programme offers selected business sellers educational support, including:
- Guidance from an eBay Marketplace Advisor
- Educational content and best practice tips
- Clarification and explanation of eBay policies applicable to your account
- This is an education-only programme. It does not affect eBay’s enforcement processes and does not delay, prevent, or reverse policy actions.
- eBay retains the right to take enforcement action at any time — including listing removals, account restrictions or suspensions — regardless of Programme participation.
- The Programme is currently offered at no cost. eBay may introduce fees with prior notice.
5. Programme Updates and Termination
- eBay reserves the right to amend, suspend temporarily and/or terminate the Programme at any time in the event of circumstances arising which, in eBay's opinion, make it necessary for it to do so. eBay shall provide You with advance notice where there is a material change to the Programme and/or if the Programme is suspended temporarily or terminated.
- You may opt out from the Programme at any time. The opt out will be effective within 14 business days of notifying us.
- Clauses 5 (Programme Updates and Termination), 6 (Confidentiality), 7 (Privacy), 8 (Limitation of Liability), 9 (General) shall survive the termination or expiration of these T&Cs.
6. Confidentiality
- “Confidential Information” means all information (whether in written, electronic or oral form) disclosed or made accessible by one party (the “Disclosing Party”) to the other party (the “Receiving Party”), or its officers, directors, employees, consultants, contractors, subcontractors, agents, advisors and other representatives of such party (“Representatives”) under these T&Cs and for purposes of the Programme that is not generally known to the public and that is designated as confidential or otherwise should reasonably be understood as confidential given the nature and circumstances of its disclosure. Confidential Information shall not include: (a) information that is or becomes publicly available through no act or omission of the Receiving Party; (b) information rightfully disclosed to the Receiving Party by a third party not bound by any confidentiality obligation with respect to such information; (c) information developed by the Receiving Party independent of any of the Disclosing Party’s Confidential Information; or (d) information that is rightfully in the possession of the Receiving Party and not subject to any duty of confidentiality as of the Effective Date.
- The Receiving Party may use the Confidential Information solely for purposes of the Programme. No other use will be made of the Confidential Information by the Receiving Party or its Representatives, it being recognised that the Disclosing Party has reserved all rights to the Confidential Information not expressly granted herein. The Receiving Party shall, and shall cause its Representatives to, protect the Confidential Information by using the same degree of care, but no less than a reasonable degree of care, to prevent the unauthorised disclosure of such Confidential Information as the Receiving Party uses to protect its own confidential information of a like nature.
- The Receiving Party shall not, and shall cause its Representatives not to, directly or indirectly disclose, copy, distribute, republish or allow any third party to have access to any Confidential Information without the prior written consent of the Disclosing Party.
- You shall not make any public statement or press release regarding these T&Cs and the Programme or any aspect thereof without the prior written approval of eBay.
7. Privacy
- Any personal data collected in connection with the Programme will be processed in accordance with eBay’s User Privacy Notice. Such personal data may be used to contact You in connection with the Programme, including when our Marketplace Advisors need to reach You about a potential policy issue on Your account.
8. Limitation of Liability
- Nothing in these terms shall limit either party’s liability for death or personal injury resulting from negligence or fraud.
- Subject to clause 8(a), eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by You resulting directly or indirectly from entry to or participation in the Programme.
- eBay does not accept, and is not responsible for, any lost or delayed acceptance to the Programme. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect acceptance to the Programme.
- eBay will use reasonable efforts to ensure that all information relating to the Programme ("Programme Material") is accurate, however eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Programme or the Site, including without limitation the accuracy of any Programme Material.
9. General
- eBay Policies. In case of conflict between the terms of these T&Cs and the eBay Policies, the terms of these T&Cs will prevail only to the extent of the conflict.
- eBay reserves the right to amend any part of these T&Cs upon notice to You (email is sufficient).
- Any attempt to manipulate the Programme is prohibited and may result in exclusion from participation.
- eBay reserves the right to verify your eligibility for the Programme.
- These T&Cs are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these T&Cs.
